Terms and Conditions

I will only use the trial in the United States and in any country that is a party to the Berne Copyright Convention, subject to compliance with applicable U.S. export laws and regulations. I will comply with all applicable local, state, federal, and foreign laws in using the trial and, if using the trial outside of the United States, not use the trial in a manner that would violate any federal or state laws of the United States if conducted therein. I will use the trial solely for evaluation purposes, and will not license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the trial available to any third party.

I will not use the trial (i) in connection with any criminal or civil violations of state, federal, or international laws, regulations, or other government requirements. Such violations include, but are not limited to, theft or infringement of copyrights, trademarks, trade secrets, or intellectual property of any type; fraud; forgery; theft or misappropriation of funds, credit cards, or personal information; and threats of physical harm or harassment (ii) in connection with any attempt to violate the security of any network, service, or other system, including, but not limited to, hacking, cracking into, monitoring, or using systems or networks without authorization; scanning ports; conducting denial of service attacks; and distributing viruses or other harmful software (iii) to transmit materials of a threatening nature, including threats of death or physical harm, harassment, libel, and defamation (iv) for the distribution of offensive materials, including obscene, pornographic, indecent, and hateful materials (v) for the distribution of spam.

The use of this trial environment is as is and Kadient makes no warranties or representations in connection therewith, including but not limited to, any and all implied warranties or conditions of merchantability, fitness or suitability for any purpose (whether or not Kadient knows, has reason to know, has been advised, or is otherwise in fact aware of any such purpose), or non-infringement. Kadient Software, Inc. may enable or disable my access to the trial environment at its discretion.

THE PARTIES AGREE THAT KADIENT SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES ARISING FROM, OR AS A RESULT OF, THE USE OF THE TRIAL ENVIRONMENT, EVEN IF KADIENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If I am uploading my content to the Kadient upload site, I am doing so with the express knowledge that this information will be accessed by Kadient staff, and used to populate a trial knowledge base in the trial environment. I have sole responsibility for the accuracy, quality, integrity, legality, reliability, and appropriateness of uploaded data for this purpose. Further, I agree that Kadient shall not be required to keep such information confidential.
